The law establishing the mandatory electronic Declaration of income of officials in 2016 and determines that criminal liability for filing officials of doubtful data in declarations on incomes occurs in the event that such information differs from authentic amounting to more than 250 minimum wages (currently - UAH 1 378), 344 500 hryvnias, came into force.
On March 17 the law was published in the official parliamentary newspaper "The Voice Of Ukraine". The law shall enter into force on the day following the day of publication, respectively, from 18 March.
The law mitigated criminal liability for filing false information in declarations and punishable (in addition to deprivation of liberty for a term up to 2 years) in the form of a penalty from 2,5 thousand to 3,5 thousand non-taxable minimum incomes of citizens (42,5-59,5 thousand UAH) or public works for the term from 150 till 240 o'clock.
In addition, the law provides for administrative liability for submission of false information in the form of a penalty from 1 thousand to 2,5 thousand non-taxable minimum incomes (17-42,5 thousand hryvnia).
Such liability is incurred if the Declaration submitted data differs from the accurate worth from 100 to 250 amounts of minimum salary (to 137.5-344,5 thousand)
In addition, the law introduces changes to article 50 of the law "On corruption prevention" and found that a full scan of the Declaration of income may be conducted during implementation of their official powers and within 3 years after the cessation of such activities.
Under previous law, a full scan of the Declaration of income was carried out for 90 days from the date of the Declaration.
In 2016 government employees occupying managerial and sensitive positions, within 60 calendar days after the start of operation of the system are obliged to file electronic declarations.
The law establishes that the disclosure statements shall include information about the place of registration and actual residence and registered place of residence and place of actual residence or mailing address, to which the subject of the Declaration by the National Agency on corruption prevention can be sent correspondence.
The Verkhovna Rada adopted this law on 15 March, President Petro Poroshenko signed it on the night of March 16.
